Notable Commercial Litigation
Our law firm has handled a number of important cases with rulings that have changed the way courts interpret the law. One of our notable successes is a court ruling that there is no fiduciary duty among members of an LLC. This was interpreted by business and legal scholars as being one of the most important cases of the year (Virginia Lawyers Weekly – 2007).
In mid 2007 we represented a public company in the matter of a Bulk Sales Act claim involving novel areas of the law that had been yet undecided under state law, eventually prevailing on all counts at trial.
In October of 2007 we prevailed on a $111 million preliminary injunction in a matter involving pending patents, and the infringement of trademarks, copyrights and theft of trade secrets in the Federal Court for the Southern District of Florida.
In 2006 the Fairfax County Circuit Court made the first and only ruling in the state’s history, based upon our briefing and argument that Federal Trademark disputes share concurrent jurisdiction in state and Federal Courts.
